1. GENERAL REQUIREMENTS

1.2 Acceptance of Terms
By requesting a Postal Pack, posting items to Sell My Silver UK, or using any of our services, you confirm acceptance of these terms and conditions in their entirety. This constitutes a legally binding agreement.
1.3 Customer Eligibility
– You must be at least 18 years old
– You must be legally capable of entering binding contracts
– You must be a UK resident
– You must use our services for personal, non-commercial purposes only
– All information provided must be true, accurate and complete
1.4 Ownership and Authority
– You warrant you are the legal owner of all items sent to Sell My Silver UK.
– Items must be free from any liens, charges, or adverse claims
– You must act on your own behalf, not as an agent for others
– We reserve the right to request proof of purchase for any items
– You guarantee items are not proceeds of illegal activities
1.5 Documentation Requirements
Upon request, you agree to provide any documentation supporting compliance with these terms, including but not limited to:
– Proof of identity
– Proof of ownership
– Proof of purchase
– Any other reasonable documentation we require
1.6 Prohibited Items
You must not send:
– Hazardous materials
– Items obtained illegally
– Items that would cause us to breach anti-money laundering or anti-terrorism laws
– Any materials that could pose health, safety or security risks
2. HOW OUR SERVICE WORKS
2.1 The Process
a) Request a free Postage Pack via our website
b) Send your items using our pre-paid Royal Mail Tracked Returns 24h Service
c) We test and value your items upon receipt
d) For instant payment customers: immediate payment processed
e) For contact customers: we provide valuation and await your decision
f) Payment sent or items returned based on your choice
2.2 Nature of Transaction
For instant payment customers: By selecting instant payment and posting items, you make an irrevocable offer to sell at our valuation. This cannot be withdrawn once posted.
For contact customers: By posting items, you are requesting a professional valuation. You may accept or reject our offer, subject to fees in Section 9.
If we’ve provided a quote before posting (rare): That quote may be binding subject to our verification of items upon receipt.
The contract is formed when:
– We process instant payment (instant payment customers), OR
– You accept our valuation (contact customers), OR
– 14 days pass without payment of rejection fees (automatic acceptance)
2.3 No Advance Valuations
We do not provide valuations without physically testing your items. Any estimates given are for guidance only and are not binding. Actual valuations are based solely on our professional testing upon receipt.
3. POSTING AND INSURANCE
3.1 Delivery Service & Risk
All items sent to us using our prepaid return labels are dispatched via the Royal Mail Tracked Returns 24 service. All packages and items remain entirely at the risk of the customer until we have physically received, inspected, and confirmed receipt of the items at our premises.
3.2 Standard Transit Cover
Packages sent using our standard Royal Mail Tracked Returns 24 service include standard transit protection of up to £75. Please note that Royal Mail does not permit additional top-up insurance coverage to be purchased at the Post Office for Tracked Returns services.
3.3 In-House Insurance Cover
To safeguard higher-value shipments, Sell My Silver UK provides in-house insurance coverage of up to £750 for items dispatched using our designated postage services, subject to compliance with our packaging guidelines.
3.4 Requesting Higher Cover Limits
If the total value of your items exceeds £750, you can request an increased cover limit prior to posting. To request higher insurance cover, please state the estimated value of your goods by contacting us via email or chat before dispatching your package. We will confirm whether an elevated cover limit has been approved for your shipment.
3.5 Customer Packaging
We provide a protective bubble wrap envelope with every Postal Pack for the safe transit of your items. Where customers choose to include additional packaging of their own — such as boxes or outer wrapping — we will always handle these with care. However, due to the nature of our storage and processing facilities, we cannot guarantee that additional customer packaging will be retained or returned in the event of a rejected valuation. We recommend removing any packaging you wish to keep before posting your items to us.
4. INSTANT PAYMENT OPTION
4.1 Choosing Instant Payment
By selecting “pay me instantly without contacting me” you agree to:
– Irrevocable acceptance of our valuation
– Waiving all rights to reject or dispute the valuation
– No price matching available
– Payment is final and binding immediately upon processing
– Items are immediately sent for melting/refining or recycling/resale
– Cannot request return of items after payment
4.2 Instant Payment Process
– Items tested using traditional acid and/or XRF technology for accuracy
– Payment processed within average 20 minutes (not guaranteed)
– Payment sent to details provided in your Postage Pack
– Valuation breakdown available upon request for transparency
– No negotiation or amendment possible after payment
4.3 Binding Nature
Instant payment is irreversible. Once processed, you cannot:
– Dispute the valuation
– Request items back
– Claim price matching
– Reverse the transaction
5. VALUATION AND TESTING
5.1 Testing Procedures
By sending items, you explicitly consent to:
– Destructive and non-destructive testing
– Acid testing that may cause permanent marks
– Filing and scratching for purity testing
– Dismantling of items
– Removal and potential damage to stones
– XRF analysis
– Any other testing we deem necessary
5.2 Valuation Standards
– Items valued based on precious metal content only
– Craftsmanship, brand, or resale value not considered
– Gemstones generally valued at £0 unless exceptional
– We use London Bullion Market Association rates
– Valuations valid until 6pm same day only
5.3 Weight Tolerance
– We work to 2g weight tolerance
– Minor variations within tolerance processed at actual weight
– Significant variations trigger consultation process
5.4 Contact Customers
If you choose to be contacted with your valuation:
– We’ll call, email or text with our offer
– You can accept or reject our valuation
– Acceptance is binding and items immediately processed
– Rejection incurs fees (see Section 9)
Formation of Contract by Payment: Where you have specified in writing a price at which you would accept the valuation, Sell My Silver UK’s processing of payment at that price constitutes our acceptance of your offer to sell. Upon payment processing, the contract is binding and final. No refund, reversal, or return is available after payment has been processed.
5.5 ERROR CORRECTION AND OVERPAYMENTS
a) Error Identification:
– Despite careful procedures, human error may occur
– We reserve the right to correct any valuation errors
– Corrections may be identified through audit, review, quality checks, or accounting processes
b) Overpayment Recovery:
– We have 30 days from payment date to identify overpayments
– You will be notified immediately of any overpayment
– You agree to return overpaid amounts within 30 days of notification
– We may provide evidence including third-party valuation if disputed
c) Legal Remedies:
– Failure to return overpayments constitutes breach of contract
– We reserve all legal rights including:
– Debt recovery proceedings
– Interest at 8% above Bank of England base rate
– All legal and administrative costs
– Credit reference agency notification
– Criminal prosecution for fraud if applicable
d) Underpayments:
– If we identify underpayment, we’ll pay the difference immediately
– This demonstrates our commitment to fairness and accuracy
5.6 Minimum Quantities
– Gold: we require a minimum of 5g of gold content within a Postal Pack in order to provide a valuation and complete a purchase.
– Silver: we require a minimum of 100g of silver content within a Postal Pack in order to complete a purchase.
– Mixed packs: where a pack contains both gold and silver, meeting the minimum for either metal removes the minimum for the other. A pack containing at least 5g of gold qualifies in full, and we will purchase any quantity of silver sent with it. A pack containing at least 100g of silver qualifies in full, and we will purchase any quantity of gold sent with it, including where that gold content is below 5g.
– Below both minimums: where a pack contains less than 5g of gold and less than 100g of silver, we are unable to provide a valuation or make a purchase. The pack will be subject to our handling fee and the cost of Royal Mail return postage, invoiced in accordance with Section 9.
6. GEMSTONES
6.1 Gemstone Valuation
– Gemstones generally have no value to us
– Removal costs often exceed gemstone value
– Exceptional gemstones may be valued at our discretion
6.2 Gemstone Handling and Return
Where gemstones or diamonds of considerable size, quality, or value are received, these will be factored into your total valuation at live market rates and purchased alongside your gold and/or silver. Where stones are not of significant value, our team will endeavour to dismantle and isolate them from the gold and/or silver as carefully as possible prior to the refining process, and to return them to you where practicable. We are gold & silver buyers, not gemstone specialists, and whilst our team will always make every reasonable effort to return stones that have not been included in your valuation, this cannot be guaranteed in every situation — particularly where settings or fixtures make safe removal difficult. By sending items containing gemstones, you acknowledge and accept this limitation.
7. PAYMENT TERMS
7.1 Payment Methods
– Bank transfer (same-day for UK accounts)
– PayPal (fees may apply)
– Cheque (first-class post)
7.2 Payment Timing
– Instant payment: Average 20 minutes (not guaranteed)
– Contact customers: Upon acceptance of valuation
– All payments subject to security and compliance checks
7.3 Payment Conditions
– Payments are final and irreversible once processed
– No amendments after payment issued
– Payment constitutes full settlement of transaction
8. OWNERSHIP AND RISK
8.1 Title Transfer
Ownership remains with you until:
– We process instant payment, OR
– You accept our valuation, OR
– 14 days pass without payment of rejection fees
8.2 Risk Allocation
– You bear all risk until we sign for receipt
– We bear risk after receipt ONLY for our negligence
– Return transit risk transfers when Royal Mail collects
8.3 Liability Limitations
Our maximum liability is limited to the lower of:
– Actual metal value at current market rate
– £5,000 per transaction
– Amount paid to you
8.4 Excluded Losses
We accept no liability for:
– Loss of profit or business
– Sentimental value
– Consequential losses
– Third-party claims
8.5 Insurance Subrogation Waiver
You waive all rights for insurance claims against us. Your insurers cannot pursue subrogation claims against Sell My Silver UK.
9. REJECTION AND FEES
9.1 Rejecting Our Valuation
If you reject our valuation, the following fees apply: – £15 testing and handling fee – Actual Royal Mail Special Delivery return postage – Any additional insurance costs you paid (not refunded) – Fees must be paid within 14 days
9.2 Applicability of Return Fees
Return fees apply regardless of whether the gold or silver content of your parcel meets our minimum 5g requirement. As a small, family-run business operating on tight margins — our only margin being made through the purchase of precious metals — the returns invoice is not a revenue stream for us. It exists purely to protect against the fixed costs of insured logistics, storage, testing, and return postage that are incurred on every parcel we receive. Our pricing model is designed to be competitive precisely so that returns are never necessary, as our clear intention is always to purchase your items rather than return them.
9.3 Automatic Acceptance
If fees are not paid within 14 days: – Your rejection is void – Our valuation is automatically accepted – Items sent for processing immediately – Payment processed to your account – This is legally binding and irreversible
9.4 Returned Items Condition
Items may be permanently altered from testing – Stones may be removed or damaged – We’re not liable for restoration – Returns sent via Royal Mail Special Delivery
9.5 Unable to Contact
If we cannot reach you after valuation: – We’ll make at least 3 contact attempts over 28 days – Attempts via phone, email, and/or text to details you provided – We maintain records of all contact attempts with dates and times – After 28 days with no response, payment automatically processed – Payment sent via your chosen method (bank transfer, PayPal, or cheque) – This constitutes acceptance of our valuation – You cannot dispute the valuation after this point – Evidence of attempts available upon request
10. NON-PRECIOUS ITEMS
10.1 Items Containing No Gold/Silver Content
Where a Postal Pack is received and testing confirms no gold or silver content is present, we will contact you promptly with two options: we can raise a returns invoice to cover the cost of an insured Royal Mail Special Delivery return, providing full delivery confirmation and tracking, or we can responsibly recycle the item in-house at no cost to you.
As a gold & silver buyer operating alongside a live and fluctuating price, it is essential that all purchased items move through to processing and refining/recycling as efficiently as possible. We are therefore unable to store non-gold and non-silver items indefinitely whilst awaiting a response. Any items for which we have not received a decision within 5 working days of our initial contact will be sent for responsible in-house recycling. We strongly recommend responding promptly upon receipt of our correspondence to ensure your preferred option is actioned in time.
10.2 Discretionary Returns of Non-Precious Items and Limitation of Liability
Separately from the standard return process set out in clause 10.1, we may, at our sole discretion, arrange the return of non-precious items. Any such discretionary return is sent using a tracked Royal Mail service, such as Royal Mail Tracked 24 or Royal Mail Tracked 48. Our fully insured Royal Mail Special Delivery service, as described in clause 10.1, is reserved for standard returns and for items of precious-metal value; as non-precious items carry no such value, there is nothing to insure, and a tracked service is used for any return made at our discretion.
Every such return is dispatched with a Royal Mail tracking reference that records its progress from our facility through to delivery. Accordingly:
– Our responsibility for the return is discharged in full once Royal Mail’s tracking confirms the item has been delivered.
– As the service is tracked but uninsured, and as the items hold no precious-metal value, we accept no liability for any loss, delay, damage or claim of non-receipt once the item has entered the Royal Mail network, save as confirmed by the tracking record.
– It is your responsibility to provide a complete and correct delivery address; we are not liable for returns that fail to reach you as a result of an incomplete or inaccurate address.
10.3 Failed Delivery of Returns
– Uncollected returns come back to us
– £10 fee for each redelivery attempt
– Items disposed after 30 days if unclaimed
11. SPECIAL PROCESSING
11.1 Silver Processing
– Silver may take up to 14 days to process
– High-volume parcels subject to additional delays
– Trade parcels processed separately
– We’ll notify you of any extended delays
11.2 Items Sent in Error
If you accidentally send items not intended for sale:
– £20 return fee applies
– Covers postage, insurance, and administration
– Must be claimed within 14 days
– Unclaimed items may be processed
12. LEGAL TERMS
12.1 Indemnification
You indemnify us against all claims, losses, costs and damages arising from:
– Your breach of these terms
– False ownership claims
– Illegal items
– Third-party claims
– Any misrepresentation
12.2 Force Majeure
We’re not liable for delays or failures due to circumstances beyond our control including but not limited to:
– Natural disasters
– War or terrorism
– Pandemic or epidemic
– Government actions
– Market closures
– Strikes or labour disputes
12.3 Intellectual Property
No licence granted to use our trademarks, logos, or intellectual property without written consent.
12.4 Data Protection
– We comply with all data protection laws
– Personal data used only for transaction purposes
– We may contact you regarding your transaction
– Marketing only with explicit consent
12.5 Jurisdiction
– Governed by English law
– Exclusive jurisdiction of English courts
– Disputes resolved in England and Wales
12.6 Severability
If any clause is deemed invalid, remaining terms continue in full force.
12.7 Waiver
No failure to enforce rights constitutes waiver of those rights.
12.8 Entire Agreement
These terms constitute the entire agreement. No verbal variations are valid.
13. PRICE MATCH GUARANTEE
13.1 Conditions
– Written competitor quote required
– Must be dated within 7 days of our valuation
– From recognised UK gold buyer only
– Not available for instant payment customers
– Must be claimed before accepting our valuation
13.2 Exclusions
– Cannot be claimed after payment
– Adjusted for market movements
– Not applicable after acceptance
– Instant payment customers excluded entirely
